ORDERED that the following claims are DISMISSED WITH PREJUDICE: (a) Claims 9, 13, 14, 17, 19, and 30-32 based on a procedural bar; (b) Claims 26 and 33 onthe merits as a matter of law; and (c) Claim 7 as not cognizable. No later than sixty (60) days following entry of this Order, Petitioner shall file a Memorandum regarding the merits only of Claims 1-6, 8, 10-12, 15, 16, 18, 20-25, and 27-29. no later than forty-five (45) days following the filing of Petitioner's Memorandum, Respondents shall file a Response Re: Merits. no later than twenty (20) days following the filing of Respondents' Response, Petitioner may file a Reply. The Clerk of the Court shall, pursuant to Fed. R. Civ. P. 25(d), substitute, as a Respondent, Dora B. Schriro for Terry Stewart as Director of the Arizona Department of Corrections. The Clerk shall update the title of this case to reflect this substitution. The Clerk of Court forward a courtesy copy of this Order to the Clerk of the Arizona Supreme Court.
