ORDER (Service Packet) - IT IS ORDERED: Plaintiff's Application to Proceed In Forma Pauperis is granted. Plaintiff must pay the $250.00 filing fee and is assessed and initial partial filing fee of $5.80, as required by the accompanying Order to the appropriate government agency. That Counts I and III are dismissed without prejudice. That the following Defendants will be dismissed from this action without prejudice: Schriro, Stewart, Youssef, Echols, Alkire, Sote, Britt, Stewart Two, and Sgt. John Doe. John Doe; Echols; Schriro; Sote; Stewart; Stewart Two; Youssef; Alkire and Britt terminated. The Clerk of Court shall send Plaintiff a service packet including the Complaint, this Order, and both summons and request for waiver forms for Defendants: Sabbagh and Broaderick. Service Packet due by 7/6/2006.Defendants shall answer the Complaint or otherwise respond by appropriate motion within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of Civil Procedure. This matter is referred to Magistrate Judge Lawrence O. Anderson pursuant to Rules 72.1 and 72.2 of the Local Rules of Civil Procedure for further proceedings. ORDER FOR PAYMENT OF INMATE FILING FEE Directing Monthly Payments be made from Prison Account of Rick Alton Foley. IT IS ORDERED: The Director of the Arizona Department of Corrections or her designee must forward to the Clerk of Court the $5.80 initial partial filing fee. The balance of the $250.00 filing fee must be collected from Plaintiff's trust account in monthly payments that are equal to 20 percent of the preceding month's income credited to Plaintiff's trust account. Payments must be forwarded to the Clerk of the Court each time the amount in the account exceeds $10.00. The Clerk of the Court must serve by mail a copy of this Order on the Director of the Arizona Department of Corrections, 1601 West Jefferson, Phoenix, AZ, 85007. The Clerk of the Court must serve by mail a copy of this Order on Michael Brodsky, Office of the Arizona Attorney General, 1275 West Washington, Phoenix, AZ 85007. The Clerk of Court shall forward a copy of this Order to Financial Administration for the Phoenix Division of the US District Court for the District of Arizona. FURTHER ORDERED that the Clerk of Court must dismiss without prejudice Plaintiff's claim that Sabbagh violated his constitutional rights by removing him from his religious diet. FURTHER ORDERED that Defendants' 11 Motion to Dismiss isDENIED in part. Therefore, Plaintiff may proceed against Broaderick as to Plaintiff's claim that his constitutional rights were violated by the retaliatory refusal to reinstate his religious diet.
