IT IS FURTHER ORDERED granting 43 Motion to Amend/Correct Complaint and that the Clerk of the Court shall file and docket the pla's amended complaint 50 as the pla's First Amended Complaint. IT IS FURTHER ORDERED that dft George Contreras shall answer the allegations against him in Counts I and II of the First Amended Complaint. IT IS FURTHER ORDERED that dfts Police Chief Doe, Jeffrey Brandenberger, Jeffrey Chapman and Jose Garcia and Count III are dismissed from the First Amended Complaint. IT IS FURTHER ORDERED that the Clerk shall send the pla a service packet for dft George Contreras. The Pla shall complete and return the service packet to the Clerk within 20 days of the filing of this Order. This matter is referred to Magistrate Judge Jacqueline J.
