ORDER Pursuant to Local Rule ("LRCiv") 3.8(a), Rules of Practice, effective December 1, 2007, all civil cases are, and will be, randomly assigned to a U.S. district judge or to a U.S. magistrate judge. This matter has been assigned to the undersigned U.S. Magistrate Judge. that Plas shall each file on or before May 8, 2008 their written elections to either consent to magistrate judge jurisdiction or elect to proceed before a United States district judge. FURTHER ORDERED that Plas shall serve upon the Dft the appropriate consent form provided at the time of the filing of their Complaint at the time of service of their Complaint upon the Dft. FURTHER ORDERED that Dft shall either consent to magistrate judge jurisdiction or elect to proceed before a district judge within twenty (20) days of Dft's formal appearance herein. DOCUMENT #19 VACATED PURSUANT TO ORDER #51 FILED ON 9/28/09. DEFAULT JUDGMENT - IT IS ORDERED that Dft SCH Electric, L.L.C. file with theCourt and Plas' authorized representative accurate and completed contribution reporting forms for the months of February, 2008 through, and including, July, 2008 no later than ten (10) calendar days after being served with certified copies of this Court's Findings of Fact and Conclusions of Law and Default Judgment. When filing said contribution reporting forms, Dft shall pay all delinquent contributions shown to be due for such reported work by Dft's employees for the months of February, 2008 through, and including, July, 2008; and, Dft shall timely file accurate and complete contribution reporting forms and shall timely pay contributions due after today's date as required by law until such time as Dft files and delivers a truthful "Stop Card" with the appropriate representative of Plas. FURTHER ORDERED that Plas shall have Jgm against Dft SCH Electric, L.L.C. in the sum of $2060.00 for reasonable atty's fees and $350.00 for court costs incurred herein. FURTHER ORDERED that Plas may timely apply for recovery of additional reasonable atty's fees and court costs incurred after today's date in enforcing the terms of this Jgm and for such other and further relief, including Contempt of Court, as this Court deems just and proper.
