ORDER, Defendant Hinchey's Motion to Dismiss 197 is granted; Defendants Veach and the City of Phoenix's Motion for Summary Judgment Regarding Immunity 257 is granted; Defendant Veach is granted immunity on Counts I, II, III (federal), V, and VI; because the Court declines in its discretion to retain supplemental jurisdiction over the state law claims, Counts III (state), VII, VIII, and IX against Defendants Veach and the City of Phoenix are dismissed without prejudice; Hinchey's Motion for Summary Judgment on Qualified Immunity Grounds 213 and Plaintiffs' Cross-Motions for Partial Summary Judgment against Defendants Hinchey and Veach on Counts I and II of the SAC 291, 293 are denied as moot without prejudice; because this Order resolves all remaining Claims against all remaining Defendants, the Clerk shall enter Judgment for the remaining Defendants on Counts I, II, III, IV, V, VI, VII, VIII, IX, and XIII; the Judgment shall reflect that Counts III (state), VII, VIII, and IX against Defendants Veach and the City of Phoenix are dismissed without prejudice, consistent with this Order. Thus, Defendant Hinchey is granted immunity on Counts I, II, and III. Because these are the only claims remaining against the only remaining Defendant, the Clerk of Court shall enter judgment in favor of Defendant Hinchey and against Plaintiffs and shall close this case.
