ORDER ADOPTING IN PART AND REJECTING IN PART THE REPORT AND RECOMMENDATION 35 as provided in this order. IT IS FURTHER ORDERED that petitioner's Petition for Writ of Habeas Corpus (Doc. 1) is GRANTED. IT IS FURTHER ORDERED that the Clerk of the Court enter judgment in favor of Petitioner Stephen Edward May against Respondent Charles L. Ryan that Respondent release Petitioner from custody forthwith. IT IS FURTHER ORDERED that Respondent Attorney General Thomas Horne and successors of office, who do not have custody of Petitioner, are DISMISSED as improper parties respondent in a federal habeas corpus proceeding.
