ORDER ADOPTING REPORT AND RECOMMENDATION: the Report and Recommendation Doc. 103 is ADOPTED as the ruling of this Court. The City Defendant's Motion for Summary Judgment Doc. 84 is GRANTED with regard to Plaintiffs' claims of violation of Art. 2, Sec. 8 of the Arizona Constitution and the Tucson City Code but denied on all other grounds.
