REPORT AND RECOMMENDATION: The Magistrate Judge recommends that the District Judge enter an order DENYING Petitioner's Petition Under 28 U.S.C. § 2254 for a Writ of Habeas Corpus by a Person in State Custody (Doc. 1). Any party may serve and file written objections within fourteen (14) days after being served with a copy of this Report and Recommendation. A party may respond to another party's objections within fourteen (14) days after being served with a copy. No replies shall be filed unless leave is granted from the District Court. ORDER that the Report and Recommendation (35) is accepted and adopted. IT IS FURTHER ORDERED that the Petition Under 28 U.S.C. § 2254 for a Writ of Habeas Corpus (1) is denied, and this case is dismissed with prejudice. The Clerk of Court is directed to enter judgment accordingly and close this case. IT IS FURTHER ORDERED that the Court declines to issue a certificate of appealability, because reasonable jurists would not find the Court's procedural ruling debatable.
