REPORT AND RECOMMENDATION: The Magistrate Judge recommends the District Court dismiss the 1 Petition for Writ of Habeas Corpus (State/2254). Any party may serve and file written objections within fourteen days of being served with a copy of the Report and Recommendation. A party may respond to the other party's objections within fourteen days. ORDERED that the 24 Report and Recommendation is accepted and adopted in full. Further ordered that Petitioner's Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. 2254 is denied, and this case is dismissed with prejudice. The Clerk of Court is directed to enter judgment accordingly and close this case. Pursuant to Rule 11 of the Rules Governing Section 2254 Cases, the Court declines to issue a certificate of appealability, because reasonable jurists would not find the Courts ruling debatable.
