REPORT AND RECOMMENDATION re: 1 Petition for Writ of Habeas Corpus (State/2254). The Magistrate Judge recommends that the District Court dismiss Petitioner's Petition under 28 U.S.C. ยง 2254 for a Writ of Habeas Corpus by a Person in State Custody as procedurally defaulted or, alternatively, dismiss Grounds I, II and IV of the Petition as procedurally defaulted and deny Ground III on the merits.
