ORDER granting 52 Motion for Summary Judgment. The Clerk's Office is DIRECTED to enter a Final Judgment in accordance with this Order in favor of Defendants. This action is dismissed with prejudice as to all claims, but for the claims made in lieu of a criminal appeal which are dismissed without prejudice as is required by Rooker-Feldman. Defendants Pima County Sheriff's Department and Pima County Public Defenders Office are both dismissed with prejudice. The Motion to Strike (Doc. 53) the audio CD is GRANTED.
