OPINION filed: We AFFIRM the grant of summary judgment on Marshall’s Fourth and First Amendment claims and on the state-law false arrest claim, and REVERSE the grant of summary judgment on governmental immunity grounds on Marshall’s state-law assault and battery claims, and Chandra Marshall’s derivative loss-of-consortium claim. On remand, the district court is free to reconsider its exercise of supplemental jurisdiction over the remaining state claims; decision not for publication.
