PER CURIAM JUDGMENT [1685278] filed ORDERED that the motion to consolidate be granted and the above-captioned cases are hereby consolidated. It is FURTHER ORDERED that the motion for leave to intervene in No. 15-8009 be granted, and the petition for permission to appeal be denied. It is FURTHER ORDERED and ADJUDGED that case Nos. 16-5285, et al. be dismissed, and the matter be remanded to the district court for further proceedings. Because no appeal has been allowed as to No. 15-8009, no mandate will issue. The Clerk is directed to withhold issuance of the mandate in Nos. 16-5285, et al., until seven days after resolution of any timely petition for rehearing or petition for rehearing en banc. See Fed.
