MEMORANDUM AND ORDER signed by Judge Morrison C. England Jr. on 8/8/06 ORDERING Dft's Motion to Dismiss Pltf's First cause of action 6 is DENIED. Pltf's remaining four state law claims, however, are barred on Eleventh Amendment grounds. Because the deficiencies of Pltf's Complaint as to her state law claims cannot be cured through amendment, granting Pltf further leave to amend those claims would be futile. Dft's Motion to Dismiss 6 is accordingly GRANTED without leave to amend, as to the Second, Third, Fourthand Fifth causes of action. (Krueger, M)
