ORDER signed by Judge Gregory G. Hollows on 12/13/07 GRANTING 2 Application to proceed IFP. The petition is dismissed with leave to amend, within thirty days from the date of service of this order. Petitioner may file an amended petition or a civil rights complaint. Petitioner is cautioned that should he seek to proceed, as a plaintiff, that he will be assessed the full $350.00 filing fee, although he will retain his IFP status. Failure to comply with this order will result in a recommendation that this matter be dismissed. The Clerk is directed to send petitioner both the courts form for filing a habeas petition, as well as the form for filing a prisoner civil rights action in this district.(Anderson, J)
