ORDER signed by Judge Gregory G. Hollows on 9/21/07 GRANTING Motion to Proceed In Forma Pauperis and plaintiff Bearden is obligated to pay the statutory filing fee of $350 for this action. Plaintiff Bearden is an initial partial filing fee of $2.00. All fees shall be collected and paid in accordance with this court's order to the Director of the CDC filed concurrently herewith (in case 2:07-cv-1332 LKK GGH). The claims of plaintiff Sonny Savoy are SEVERED from the claim of plaintiff Gary D. Bearden. Plaintiff Bearden shall proceed as the sole plaintiff in case 2:07-cv-1332 LKK GGH. The clerk is directed to open a separate civil action for plaintiff Sonny Savoy and directly assign Judge Lawrence K. Karlton and Magistrate Judge Gregory G. Hollows. Each plaintiff's complaint is DISMISSED. The clerk is directed to send each plaintiff a new form for filing a civil rights action. Each plaintiff is GRANTED 30 days from the date of this order to file an amended complaint. Plaintiffs' Motion for Preliminary Injunction is VACATED without prejudice to the file of such a motion by each plaintiff upon the filing of an amended complaint by each. On all future filings in case Savoy v. M.C.S.P Chief Medical Officer et al, the case number shall be 2:07-cv-1973 LKK GGH. (Donati, J)
