ORDER signed by Magistrate Judge Gregory G. Hollows on 6/24/08 ORDERING that plaintiff's 1 Notice of federal civil rights suit, is DISMISSED with leave to amend to file either an amended civil rights complaint or a petition for writ of habeas corpus within 30 days. Plaintiff shall also submit, within 30 days from the date of this order, the application to proceed IFP on the form provided by the Clerk, or the filing fee in the amount of $350.00 (amended complaint) or $5.00 (petition), as appropriate. Plaintiff's failure to comply with this order will result in a recommendation that this matter be dismissed.
