Petitioner's request to add an additional claim 10 is construed as a motion to amend. Construed as a motion to amend, petitioner's motion to stay 10 is GRANTED with respect to petitioner's prosecutorial misconduct claim, but denied as to his Fourth Amendment and ineffective assistance of counsel claims. Petitioner may file an amended petition that includes his prosecutorial misconduct claim within 30 days from the date of this order. Petitioners motion to amend 20 is DENIED.(Dillon, M)

If petitioner wishes to pursue all four of his claims, that is, those raised in the original petition and the first amended petition, he must file a second amended petition that includes all four of his claims within 30 days of the date of this order.
