All fees shall be collected in accordance with the court's CDC order filed concurrently herewith. Plaintiff's claims for equal protection, violation of the ADA, conspiracy, and failure to protect based on failure to report are dismissed with leave to amend. Plaintiff has the option to proceed immediately on his Eighth Amendment claims against defendants Cherniss, Olmedo, and Duffy, as set forth in Section V above, or to amend the complaint. Within 21 days of service of this order, plaintiff shall complete and return the attached form notifying the court whether he wants to proceed on the screened first amended complaint or whether he wants to file a second amended complaint.
