ORDER signed by Magistrate Judge Allison Claire on 12/16/15 ORDERING that Plaintiff shall, within 30 days after the filing date of this order, submit to the court: (a) a completed affidavit in support of his request to proceed in forma pauperis, including completion of the certificate portion of the affidavit, on the form provided herewith by the Clerk of Court; and(b) a certified copy of plaintiffs prison trust account statement for the six-month period immediately preceding the filing of his complaint. The Clerk of the Court is directed to send plaintiff a new Application to Proceed In Forma Pauperis By a Prisoner. ORDER, FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Allison Claire on 4/18/2018 ORDERING plaintiff's 8 request to proceed IFP is GRANTED; plaintiff's 2 initial request was incomplete and is DENIED as moot. Plaintiff shall pay the $350.00 filing fee in accordance with the concurrent CDCR order. Service is appropriate for Scott Kernan and Jeffrey Carrick, on plaintiff's Eighth and Fourteenth Amendment claims as set forth in her First Amended Complaint. The Clerk shall: (a) Modify plaintiff's name on the case docket to reflect that set forth in plaintiff's First Amended Complaint and the title of this order; (b) Substitute current CDCR Secretary Scott Kernan for former CDCR Secretary Jeffrey Beard as a defendant herein; (c) Attach plaintiff's exhibits 9 to the First Amended Complaint 10, and file the combined document as plaintiff's "Operative First Amended Complaint & Exhibits"; (d) Send plaintiff forms for service to be completed and returned within 30 days, along with the Notice of Submission. IT IS RECOMMENDED that recommending that defendants Governor Brown and J. Lewis be dismissed from this action. Referred to Judge John A. Mendez; Objections to F&R due within 14 days. (Yin, K)
