MEMORANDUM and ORDER RE 9 MOTIONTO DISMISS signed by Senior Judge William B. Shubb on 7/25/2016: IT IS ORDERED that defendants' motion to dismiss plaintiff's wrongful termination in violation of public policy, negligent infliction of emotional distress, and intentional infliction of emotional distress claims be, and the same hereby is, GRANTED and those claims are DISMISSED WITH PREJUDICE; and defendants' motion to dismiss plaintiff's defamation, ADEA, and "federal and state retaliation" claims be, and the same hereby is, GRANTED and those claims are DISMISSED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that plaintiff's requests for punitive damages against the County and on his ADEA claim be, and the same hereby are, stricken from the Complaint. Plaintiff has twenty days from the date this Order is signed to file an amended complaint, if he can do so consistent with this Order. (Kirksey Smith, K)
