Defendants' Stewart and Doane's 10 motion to dismiss be granted as follows: Plaintiff's Fourth Amendment claim be dismissed without leave to amend; Plaintiff's First Amendment claim be dismissed with leave to amend; The court decline to exercise jurisdiction over plaintiff's Bane Act claim. Plaintiff be granted thirty days from the date of any order adopting these findings and recommendations to file a second amended complaint. Motions referred to Judge Troy L. Nunley.
