RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE re 44 MOTION to Dismiss , ORDER re: 76 MOTION for Ruling filed by Bob Allen Custard, and notice to Plaintiff regarding potential future sanctions. The court RECOMMENDS granting the motion to dismiss in part and DENIES the motion to dismiss in part. Plaintiff's motion (76) is DENIED as moot.
