RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE by Magistrate Judge Nina Y. Wang on 6/6/2017. The undersigned Magistrate Judge respectfully RECOMMENDS that Defendants Colorado Public Utilities Commission, Jeffery P. Ackermann, Frances A. Koncilja, and Wendy M. Moser's Motion to Dismiss Under Fed. R. Civ. P. 12(b)(1) and 12(b)(6) 16 be GRANTED; Prospective Intervenor Public Service Company of Colorado's Motion to Intervene 15 be DENIED AS MOOT with leave to re-file, if necessary; and Prospective Intervenor Black Hills/Colorado Electric Utility Company, LP's Motion to Intervene 20 be DENIED AS MOOT with leave to re-file, if necessary. IT IS FURTHER ORDERED that the Scheduling Conference set for June 22, 2017, at 10:30 a.m. is VACATED; and Within three (3) business days of the disposition of this Recommendation, to the extent that Judge Arguello's Order does not fully dispose of this matter, the Parties shall jointly CONTACT the Chambers of Magistrate Judge Wang to schedule a status conference to discuss further scheduling of this matter.
