ORDER GRANTING MOTION TO DISMISS FOR LACK OF PERSONAL JURISDICTION. ORDERED: 1. Defendant's Motion to Dismiss Pursuant to Fed.R.Civ.P 12(b)(2) 8 is GRANTED IN PART and DENIED IN LIMITED PART; 2. Defendant's Motion is GRANTED to the extent that it requests a dismissal of Plaintiff's claims; 3. The Court exercises its discretion to DENY that portion of Defendant's Motion which seeks an award of costs and/or attorney's fees; 4. Plaintiff's claims are DISMISSED WITHOUT PREJUDICE FOR LACK OF PERSONAL JURISDICTION; and, 5. The Clerk of Court is DIRECTED to TERMINATE this action, by Judge William J. Martinez on 1/30/2018.
