ORDER: As set forth in the attached Findings of Fact and Conclusions of Law (163 pages), the Court hereby finds that Defendant Neri is entitled to recover $772,799.00 plus prejudgment interest at the rate of 10% per annum from January 1, 2002 to the date Judgment is entered on its Counterclaim against Elm Haven and its Third-Party Complaint against American Casualty. The Clerk is directed to enter Judgment accordingly. This is not a recommended ruling, as the parties have consented to have the Undersigned conduct all proceedings in this case, including the entry of Judgment. Signed by Judge William I. ORDER granting in part and denying in part 181 Defendant Neri's Motion to Amend/Correct Judgment; and granting in part and denying in part 182 Plaintiff Elm Haven & Third-Party Defendant American Casualty's Motion to Alter or Amend Judgment. As set forth in the attached ruling, the Clerk is directed to enter an Amended Judgment in favor of Neri Construction LLC and against Elm Haven Construction LP and American Casualty Company of Reading, PA, jointly and severally, in the amount of $772,915.00, plus prejudgment interest at the rate of 10% per annum, or $211.76 per day, from January 1, 2002, until the date the Amended Judgment is entered.
