ORDER: Defendants' motion to dismiss for lack of jurisdiction (Doc. #265) is DENIED. Plaintiff's renewed motion for sanctions (Doc. #199) is GRANTED as it applies to Sophien and Imed Bennaceur, and DENIED as it applies to TriPlanet, without prejudice to renewal in the event that the bankruptcy stay is lifted. Both plaintiff's and defendants' motions to adjust the Rule 26(f) scheduling order (Docs. #224, #220) are DENIED as moot. Defendants' motion to seal (Doc. #258) is GRANTED. Plaintiff's motion for a protective order (Doc. #212) is DENIED without prejudice to renewal in the event that the bankruptcy stay is lifted as to defendant TriPlanet. Plaintiff's motion to preclude and strike defendant's letter (Doc. #274) is DENIED. IT IS ADJUDGED AND ORDERED THAT default judgment shall enter in favor of plaintiff and against both Sophien and Imed Bennaceur as to Counts II (violation of the Connecticut Wage Statute), IV (Fraud), VI (Violation of ยง 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5), VII (Breach of Fiduciary Duties), and VIII (Conversion). Count XI (Constructive Trust) is converted into a request for relief. Plaintiff is awarded default damages in the amount of $8,136,222.60. Please see attached order. Signed by Judge Jeffrey A.
