ORDER. For the reasons stated in the attached ruling, plaintiff's 19 Motion for Summary Judgment is DENIED. The parties shall file a Joint Trial Memorandum within 60 days of this order. Instructions for completing the Joint Trial Memorandum are available at http://ctd.uscourts.gov/sites/default/files/Joint%20Trial%20Memorandum%20Instructions%20%28as%20of%207.9.14%29.pdf. If both parties want the Court to refer this matter for settlement with a Magistrate Judge or Para-Judicial Officer, they shall file a joint statement certifying that (1) counsel have conferred with their clients and each other, (2) the parties wish to proceed to mediation, (3) the parties are willing to participate in settlement efforts at such mediation in good faith, and (4)counsel believe that a mediation stands at least a reasonable chance of resolving the case without trial.
