ORDER: Plaintiff's Motion for Order 61 is DENIED as MOOT. His Motion for Leave to Submit a Supplemental Local Rule 56(a)2 Statement of Disputed Factual Issues 62 is DENIED. Defendant's Motion for Summary Judgment 45 is GRANTED as to the claim for illegal search but DENIED as to the claim for use of excessive force. The Court will appoint counsel to represent Mr. Raffone, and the case will proceed to trial on the excessive force claim.
