ORDER DENYING POST-TRIAL MOTIONS. As explained in the attached Order, defendant's motions for judgment of acquittal pursuant to Fed. R. Crim. P. 29 (Doc. #87), for a new trial pursuant to Fed. R. Crim. P. 33 (Doc. #102), and for an arrest of judgment pursuant to Fed. R. Crim. P. 34 (Doc. #103) are all DENIED. MEMORANDUM OF DECISION RE SENTENCING GUIDELINES CALCULATION. For the reasons in the attached memorandum of decision, the Court concludes that the Government has proved by a preponderance of evidence a total of $25,746 of loss for purposes of the Sentencing Guidelines. Based on defendant's lack of criminal history, the Sentencing Guideline range is 15-21 months imprisonment. This calculation is set forth without prejudice to the parties' arguments for a departure or variance from the prescribed Guidelines range.
