ORDER granting in part and denying in part 13 Motion to Dismiss for Lack of Jurisdiction; granting 14 Motion to Dismiss for Lack of Jurisdiction. The State DOE's motion to dismiss is GRANTED, and the State DOE is dismissed from this case. The Clerk of the Court is instructed to remove this party from the case and to amend the caption accordingly. Southington's motion to dismiss is DENIED in part and GRANTED in part. Southington's argument that the Court lacks jurisdiction to hear Plaintiffs' IDEA claims, fails, at least for now and is DENIED accordingly.
