OMNIBUS ORDER granting 16 Plaintiff's Motion for Partial Summary Judgment and denying 22 Defendant's Amended Motion for Cross-Summary Judgment. My earlier ENDORSED ORDER (D.E. 53) granted Defendant's Amended Motion, on a procedural basis, as it permitted Defendant to amend its original cross-motion 18. However, my ENDORSED ORDER (D.E. 53) did not substantively rule on Defendant's Amended Motion for Cross-Summary Judgment.
