ORDER GRANTING IN PART MOTION TO DISMISS AMENDED COMPLAINT. Defendant's Motion to Dismiss Plaintiff's Amended Complaint DE 24 is GRANTED in part and DENIED in part. The allegations about non-pecuniary damages incurred by Plaintiff and her children are STRICKEN from Counts I, II, and III. Count VI is DISMISSED without prejudice. Counts IX and XI are DISMISSED with prejudice. Count X is DISMISSED with prejudice in part. The portion of Count X based on B.B.'s emotional distress arising from witnessing the delayed and inadequate medical care K.A.B. received and from witnessing K.A.B.'s death are DISMISSED with prejudice. The Motion is DENIED in all other respects. Plaintiff shall file a second amended complaint in accordance with this Order by October 7, 2016. (Amended Pleadings due by 10/7/2016).
