ORDER REVERSING IN PART THE HEARING OFFICER'S MARCH 23, 2007 FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION, AND ORDERING REIMBURSEMENT PURSUANT TO STAY PUT 1 - Signed by JUDGE J. MICHAEL SEABRIGHT on 4/30/08. [The court REVERSES IN PART the March 23, 2007 Order to the extent it held that the August 7, 2006 IEP offered Student a FAPE. The court further ORDERS Defendants to reimburse Plaintiffs pursuant to the "stay put" provision of the IDEA for their Private School expenses incurred between the March 23, 2007 Order and service of the Complaint. Unless otherwise agreed upon by the parties, Defendants shall make payment as soon as administratively possible after receiving invoices verifying expenses during this period. The court further finds that Plaintiffs are prevailing parties in this action. The Clerk of Court is directed to close the case.] (emt, )
