ORDER on C16-3006-LTS Cross Motions For Summary Judgment and ORDER on C16-3102-LTS Motions to Dismiss, To Consolidate and For Summary Judgment. (5) Motion to consolidate in case 3:16-cv-3102-LTS is granted. Cases numbers C16-3006 and C16-3102 are hereby consolidated and shall proceed together under Case Number C16-3006. All further filings will take place on that docket. (5) Motion to Dismiss claims against Jack Walker and Todd Neff in case 3:16-cv-3102-LTS is denied. (54) Renewed Motion to Remand to State Court in case 3:16-cv-03006-LTS is denied. (37) Motion for Summary Judgment in case 3:16-cv-3006-LTS is denied. (36) Motion for Summary Judgment in case 3:16-cv-3006-LTS and (15) Motion for Summary Judgment in case 3:16-cv-03102-LTS are granted in their entirety. All of the plaintiff's claims in C16-3006 and C16-3102 are dismissed with prejudice. The clerk shall enter judgment against plaintiff in both cases. The trial scheduled to begin 5/31/2017 is canceled. (48) Motion in Limine in case 3:16-cv-3006-LTS is denied as moot.
