Mendezs Application for leave to file in forma pauperis (Dkt. 1) is GRANTED. 2. For the reasons outlined above, this action is procedurally and statutorily barred. There is no basis for removal or appeal. This case is therefore REMANDED to the Idaho Supreme Court for further proceedings. 3. Because Mendezs Complaint does not survive initial screening, there is no need to address pro bono representation. This Motion (Dkt. 5) is DISMISSED AS MOOT. 4.
