MEMORANDUM DECISION AND ORDER - IT IS ORDERED: 1. Plaintiff/Counterdefendant John F. Thorntons Motion to Quash (Dkt. 5) is DENIED. 2. Defendants Kenneth J. Barrett and Deanna L. Barretts Motion to Dismiss and Remand to State Court (Dkt. 7) is GRANTED. This case is hereby REMANDED TO STATE COURT. 3. The Court will retain jurisdiction in this matter for the sole purpose ofdetermining the amount of fees and costs to award to Defendants.
