MINUTE ORDER of 1/21/03 by Hon. Rebecca R. Pallmeyer : As plaintiff has paid the filing fee, the clerk shall file the complaint. After initial review the court determines that plaintiff may proceed with his religious discrimination claim against defendants Briley and Peterson. All other claims and defendants are dismissed. terminating parties John Doe, Donald N Snyder, Sheila M Love, Nancy S Tucker, Carmen Ruffin, Georgia Schoenauer. The clerk shall issue summons to defendants Briley and Peterson and the U.S. Marshal is appointed to serve them or obtain waiver of service as provided by Rule 4(d), Fed.R.Civ.P. MINUTE ORDER of 11/24/03 by Hon. Rebecca R. Pallmeyer : Defendants' motion to dismiss plaintiff's RLUIPA claim [24-1] is denied. Plaintiff's motion for leave to file answer to defendants' motion to dismiss complaint [39-1] and for ruling on (A) defendants' motion to dismiss plaintiff's complaint with respect to RLUIPA [41-1] [42-1] are denied as moot. Within 30 days of the date of this order, defendants shall answer the complaint and respond to plaintiff's summary judgment motion [40-1], treating plaintiff's citations to the amended complaint on p.2 of the motion as plaintiff's statement of material undisputed facts that entitle him to judgment under Rule 56(c). Plaintiff's amended complaint, made under penalty of perjury, suffices as an affidavit for purposes of Rule 56 to extent plaintiff has personal knowledge of the matters stated. Ford v.
