MINUTE ORDER of 6/16/04 by Hon. Geraldine Soat Brown : For the reasons set out in the memorandum opinion and order, defendant Sheahan's motion to dismiss plaintiff's amended complaint [14-1] is granted with prejudice as to the claim against him as an individual, and is granted without prejudice as to the claims against him in his official capacity. Defendant Aramark Correction's motion to dismiss plaintiff's complaint [13-1] is granted without prejudice. Plaintiff is given leave to file a second amended complaint curing the deficiencies discussed in the attached opinion on or before 7/7/04. Entered Memorandum Opinion and Order.
