MEMORANDUM Opinion and Order: Defendant's motion to suppress evidence pursuant to Franks v. Delaware, 438 U.S. 154 (1978). For the reasons set forth below, Defendant's motion 86 is denied. The Court concludes that an evidentiary hearing is not necessary because Defendant has failed to make a "substantial preliminary showing that a false statement knowingly or intentionally, or with reckless disregard for the truth, was included by the affiant in the warrant affidavit," or that any such statement was essential to the establishment of probable cause.
