WRITTEN Opinion entered by the Honorable Marvin E. Aspen on 3/8/2013: Plaintiff's motion for leave to file in forma pauperis 3 is granted. The court authorizes the trust fund officer at Plaintiff's place of confinement to collect $7.90 from Plaintiff's trust account as an initial partial filing fee and to continue making deductions as set out below. The clerk shall send a copy of this order to the trust fund officer at the Cook County Jail. The clerk shall issue summons for service of the complaint on Chicago Police Officers S. Prieto, J. Davis (#14710), J Crisp, C. Weatherspoon, J. Davis (#4630), G. O'Malley, P. McDonough, S. Martin, E. Johnson, C. Chimslar, and the U.S. Marshal is directed to serve them. Defendants Garry McCarthy and City of Chicago are dismissed. The clerk shall send Plaintiff a Magistrate Judge Consent Form and Instructions for Submitting Documents. WRITTEN Opinion entered by the Honorable Marvin E. Aspen on 7/1/2013: Defendants' motion to dismiss Plaintiff's state law claims 12 is granted in part. Plaintiff's state law claims of false arrest, false imprisonment, intentional infliction of emotional distress, and respondeat superior are dismissed with prejudice. His state law claim of indemnification remains and the City of Chicago is reinstated as Defendant for this claim only. The clerk shall: (1) change the docket to show that the City is still a Defendant, (2) issue summons for service of the complaint on the City, and (3) issue alias summonses for Chicago Officers S. Prieto and J. Davis (#14710). Plaintiff and Defendants are directed to submit a status report by July 31, 2013, and thereafter every 90 days, stating the status of Plaintiff's criminal case. Repeated failures by Plaintiff to file a status report may result in dismissal of this case for want of prosecution. [For further details see opinion.] Mailed notice. (np, )
