MEMORANDUM Opinion and Order. The motion of Marcus Hardy, Quentin Tanner, Royce Brown-Reed and Salvador Godinez to strike certain of plaintiff's summary judgment materials 109 is denied in large part and granted as to plaintiff's reliance on any sample of a "black substance." Defendants' motionfor summary judgment 84 is granted in part and denied in part. The motion is granted with respect to defendants Quentin Tanner and Royce Brown-Reed and on plaintiff's claim to the extent it is based on excessive noise. Judgment will be entered in favor of Quentin Tanner and Royce Brown-Reed and against plaintiff. The remainder of defendants' motion is denied.
