MEMORANDUM Opinion and Order. Signed by the Honorable Manish S. Shah on 2/8/2016: Defendants' motions to dismiss, 31, is granted in part and denied in part. Count I of the current complaint is barred by res judicata and is dismissed with prejudice. Count XI fails to state a proper claim for hostile work environment under the ADA (assuming that such a claim is actionable), and is also dismissed. Because Alanis may be able to cure some of this claim's deficiencies through re-pleading, however, it is dismissed without prejudice. The motion is otherwise denied.
