MEMORANDUM Opinion and Order: The Court grants in part and denies in part defendants motion to dismiss 18. Counts XIV, XV, XVI and XVII are dismissed with prejudice. Counts I, II, IV, V, VI, VII, VIII, IX, XI, XII and XIII are dismissed without prejudice. Because many of the defects do not seem curable, plaintiff is not granted leave to amend. If plaintiff wishes to amend any of the claims which the Court dismissed without prejudice, he will need to file a motion for leave to amend, along with a proposed amended complaint and a memorandum of law that explains how the proposed amended complaint cures the defects outlined in this decision. Status hearing set for 9/8/2014 at 11:00 a.m. Signed by the Honorable George M. Marovich on 8/25/2014:Mailed notice(clw, )
