ORDER: Plaintiff's response to the motion to dismiss 45 is construed, in part, as a motion for leave to amend the complaint. Plaintiff's motion 45 is granted. The Court grants Plaintiff leave to submit an amended complaint by April 15, 2016. Defendants' motion to dismiss 39 and Plaintiff's motion to conduct discovery to defend against the motion to dismiss 44 are denied as moot.
