The motion is granted as to the claims against Sears Holding Corp., which is dismissed as a defendant from this suit, and the unjust enrichment and ICFA claims asserted against Sears Protection and Sears, Roebuck, which are dismissed without prejudice. MEMORANDUM Opinion and Order. Defendants' motion to dismiss in part the First Amended Class Action Complaint 54 is granted as to defendant Sears Holdings Corporation, which is dismissed with prejudice as a defendant in this suit, and Count III, plaintiffs' ICFA claim, which is dismissed with prejudice. Defendants' motion is denied as to Count IV, plaintiffs' PCPL claim. The remaining defendants shall answer the remaining claims by April 17, 2017.
