ORDER. Signed by the Honorable Manish S. Shah on 5/23/2016: The motion to dismiss Counts III through VII of plaintiff's third amended complaint, 18, is granted. Count VI is dismissed, with prejudice (and without objection), as time-barred. Counts III and V are similarly dismissed, with prejudice, to the extent they allege injury from a hostile work environment; insofar as these counts rest on plaintiff's discharge, however, the claims may be re-pleaded and are dismissed without prejudice.
