MEMORANDUM Opinion: Motion to Dismiss is 20 granted in part anddenied in part. This Court dismisses Pickett's retaliation claim, his Section 1983 claim, and his claim of harassment. We also note that Pickett may not recover punitive damages against the CTA. Nonetheless, excusing Pickett's procedural defects, and construing the pleadings in the light most favorable to him, Pickett may proceed on his claim of age discrimination under the ADEA, disability discrimination under the ADA, and his failure to accommodate claim.
