ORDER Signed by the Honorable Amy J. St. Eve on 3/14/2017: The Court adopts Magistrate Judge Valdez's February 23, 2017 Report and Recommendation as it relates to Defendants' motion to enforce the settlement agreement. 57. The Court grants Defendants' motion to enforce the settlement agreement, and thus the parties' December 2016 settlement agreement is binding. Because the Magistrate Judge construed third-party Latonia Walker's February 13, 2017 motion as a response to Defendants' motion to enforce the settlement agreement, the Court denies Walker's motion as moot. 51. Due to the enforceable settlement agreement in this matter, this case is hereby dismissed, without prejudice, with leave to reinstate by May 12, 2017 to enforce the settlement. After May 12, 2017, said dismissal will convert to a dismissal with prejudice. Status hearing remains set for March 21, 2017 at 8:30 a.m. Plaintiff is directed to appear on March 21, 2017 so his signature can be obtained on the settlement agreement.
