MEMORANDUM Opinion and Order signed by the Honorable Virginia M. Kendall on 1/31/2017. The Court grants the Defendant's Motion to Dismiss Count IV (IIED) with respect to Defendants Rosenbaum, Bernhardt, Nieman, Hicks, Reza, Carrasco, Kohl, Dobrowolski, and Unknown Evanston Police Officers; Count VI (Trespass and Conversion) for all Defendants; and Count VIII (Respondeat Superior) with respect to Plaintiffs' Trespass and Conversion claim. The Court denies the Defendant's Motion to Dismiss for Count I (§ 1983 Unlawful Search and Seizure) and Count II (§ 1983 Failure to Intervene) with respect to Defendant Officers Rosenbaum, Bernhardt, Nieman, Hicks, Cherrey, Reza, Carrasco, Kohl, Dobrowolski, and Unknown Evanston Police Officers; Count III (False Imprisonment); Count IV (IIED) with respect to Cherrey; and Count VIII (Respondeat Superior) with respect to Plaintiffs' IIED claim insofar as Cherrey can be found liable.
